Protecting your private information is our priority. This Privacy Policy applies to Bracketology.tv, Inc. (“Bracketology”, “us”, “we”) website and mobile app located at www.bracketology.tv and the iOS App and Google Play Stores (“Site”) and discusses data collection, usage and disclosure of information collected from use of the Site. The Site is a Gaming site, and games, contests, and player-to-player fantasy games and pools are related to reality television/award shows and pop-culture events. These features, as well as any other features, tools, materials, or other services (including co-branded or affiliated services) offered from time to time by us or our affiliates constitute our “Services.” This Statement of Privacy Policy should be read in conjunction with our Terms of Use. By using the Site, you consent to the data practices described in this statement, and they may be updated from time to time.
Collection of your Personal Information
We may collect personally identifiable information, such as your name, username, and email address. Additionally, us or our affiliated third-party vendors may collect location, age, ID, and payment information. We may also collect anonymous demographic information, which is not unique to you, such as your age, gender, household income, political affiliation, race and religion. We may gather additional personal or non-personal information in the future.
Information about your device hardware and software may be automatically collected or actively collected by our third-party payment and ID/geolocation vendors. This information can include: your IP address, device location, browser type, domain names, access times and referring website addresses. This information is used to operate the Services, determine user eligibility for Bracketology Pool contests, maintain quality of the Services, and provide general statistics regarding use of the Site.
Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through the Site, this information may be collected and used by others.
We encourage you to review the privacy statements of websites you choose to link to from the Site so that you can understand how those websites collect, use and share your information. We are not responsible for the privacy statements or other content on websites or apps outside of the Site.
Use of your Personal Information
We collect and use your personal information to operate the Site and deliver the Services.
We may also use your personally identifiable information to inform you of other products or services available from us or our affiliates. We may also contact you via surveys to conduct research about your opinion of current Services or of potential new services that may be offered.
We do not sell, rent or lease our customer lists to third parties.
We may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. While we strive to use commercially acceptable means to protect your personal data, we underline that we shall have no liability for events for which we are not responsible.
Children Under Eighteen
Pursuant to our Terms of Service, the Site may only be used by persons eighteen years of age or older. We do not knowingly collect personally identifiable information from children under the age of eighteen.
In-App Purchases
Bracketology.tv, Inc. (“Bracketology.tv” or “we”) offers in-app purchases, including ad removal and other premium features, through Apple App Store and Google Play Store. These purchases are billed directly through your respective app store account and are subject to the platform’s payment policies. The Subscriber (“you”) must review and comply with Apple’s or Google’s terms regarding in-app purchases, including refunds or cancellations.
Additionally, Bracketology.tv, Inc. offers in-app Currency purchases that can be used to enter daily Pool contests as well as Currency redemptions for cash prizes. Currency bundle purchases are not required in order to participate in said Pools. These purchase and redemption transactions are facilitated through our third-party payment processor and are subject to the platform’s payment policies and terms.
Subscriptions
Bracketology.tv, Inc. may provide optional subscription-based Services which automatically renew until canceled. Subscriptions are not required to be purchased in order to use the general functionality of the app to play reality TV fantasy games.
Cost: Bracketology.tv currently offers 4 different subscription options for an ad-free experience.
All-Star: $18/year billed annually OR $2.49/month billed monthly, ad-free experience on both mobile and web applications, cancel anytime
Rookie: $12/year billed annually OR $1.49/month billed monthly, ad-free experience on mobile application only, cancel anytime
Subscription Period: Subscriptions renew monthly or annually on the same date as the initial purchase. If the date is not available in subsequent months, the renewal occurs on the last day of the month.
Cancellation: You may cancel any time before the next billing cycle to avoid further charges. NO REFUNDS OR CREDITS WILL BE ISSUED FOR CANCELLATIONS, BUT BENEFITS CONTINUE UNTIL THE CURRENT SUBSCRIPTION TERM ENDS.
Price Changes: We reserve the right to modify subscription prices or plans, providing at least 30 days’ notice. If you disagree, you may cancel before changes take effect.
External Subscriptions:
Apple users: Manage subscriptions via Settings > Apple ID > Subscriptions (Apple Guide).
Google Play users: Manage subscriptions via Google Play > Profile > Payments & Subscriptions (Google Guide).
If any payment fails (e.g., insufficient funds), access to subscription benefits may be suspended until payment is successful.
Licensing Grant
Bracketology.tv grants you a limited, non-exclusive, revocable license to use its Services for personal, non-commercial purposes. Unauthorized resale, distribution, or modification is prohibited.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SUBSCRIBER HEREBY RELEASES, WAIVES, HOLDS HARMLESS AND INDEMNIFIES AT POINT OF FIRST NOTICE, BRACKETOLOGY.TV, ITS AFFILIATES, AGENTS, ASSIGNS, EMPLOYEES, SHAREOLDERS AND SUCCESSORS, FROM ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR PROFITS. BRACKETOLOGY.TV’S TOTAL LIABILITY FOR ANY AND ALL ACTIONS OR CAUSES OF ACTION, CLAIMS, DEMANDS, LIABILITIES, REGULATORY, LEGISLATIVE OR JUDICIAL PROCEEDINGS OR INVESTIGATIONS, ASSESSMENTS, LEVIES, LOSSES, FINES, PENALTIES, DAMAGES, LOST PROFITS, COSTS AND EXPENSES, INCLUDING, WITHOUT LIMITATION REASONABLE ATTORNEYS’, ACCOUNTANTS’, INVESTIGATORS’, AND EXPERTS’ FEES AND EXPENSES (“CLAIM”), SUSTAINED OR INCURRED IN CONNECTION WITH THE DEFENSE OR INVESTIGATION OF SUCH CLAIM , SHALL NOT EXCEED THE NET AMOUNT PAID BY YOU (AFTER POTENTIAL CASH PRIZE REDEMPTIONS) IN THE PRIOR 12 MONTHS FROM THE DATA THE CLAIM WAS INITIATED.
Right to Change Terms
Bracketology.tv reserves the right to modify these Terms at any time, providing notice through email or the platform. Continued use following such notice constitutes acceptance of the revised Terms.
Platform-Specific Compliance
Users must comply with platform-specific terms when using Bracketology.tv through Apple App Store or Google Play Store.
Apple: Apple is not liable for support, refunds, or enforcement of these Terms.
Google: Google’s payment and subscription policies apply.
Bracketology.tv remains solely responsible for the Services, content, and support.
Payment of Fees
You agree to pay all applicable fees and taxes associated with your Account. Bracketology.tv may revise pricing for goods and services at any time. No refunds are provided for unused subscriptions, features, or virtual items, regardless of Account closure (voluntary or involuntary).
If you initiate a chargeback without notifying us, Bracketology.tv may terminate your Account at its sole discretion.
Account Termination
Canceling subscriptions does not delete your Bracketology.tv Account.
Data Storage Processes
i) A user’s email and name are captured using the sign up form.
ii) Purchase details linked to the user is stored when a user purchases any of the listed Currency packages or Subscriptions. This includes:
a. Transaction ID
b. Method of payment
c. Payment platform
d. Payment date
iii) All the user details are stored in our AWS hosted database or in a secure location with our third-party payment and verification vendors.
iv) Only the users listed in AWS IAM permission (Development teams) and Admin users have access to to our Bracketology database.
Opt-Out & Unsubscribe
We respect your privacy and give you an opportunity to opt-out of receiving announcements of certain information. Users may opt-out of receiving any or all communications from us by clicking ‘Unsubscribe’ at the bottom of our marketing emails, modifying their notification settings in their Profile, or by contacting us here:
